Scott Lively’s Pleading Spews Hateful lies about Murdered Gay Activist

By Melanie Nathan, NOV 20, 2013.

livelyPSToday, Scott Lively, the fervently anti-gay Pastor being sued by Uganda human rights organization Sexual Minorities Uganda (SMUG), under the Alien Torts Act, for persecuting gays in Uganda, filed his “Answers and Defenses to Plaintiff’s first Amended Complaint,” in the  UNITED STATES DISTRICT COURT FOR THE DISTRICT OF MASSACHUSETTS SPRINGFIELD DIVISION. (Case 3:12-cv-30051-MAP Document 83 Filed 11/20/13 Page 2 of 19)

Lively makes the basic admissions, and all the expected denials, and of course some hateful gratuitous offerings:-

One such offering is a statement which is nothing more than speculation, conjecture, and a deep insult to the memory of the late David Kato.

” In response to paragraph 10 of SMUG’s Complaint, Lively admits that David Kato is now dead because he was killed by a homosexual prostitute whom Kato hired for sexual favors and refused to pay”

This is hardly an admission but rather a submission as at no time did the Plaintiffs ever state that Kato was murdered in this fashion. In fact the convicted killer, in his confession, said Kato propositioned him and did not say he was hired for sex and unpaid.  The convicted killer’s account of events was discredited and not believed by the Judge. Many believe that Kato was set up and murdered at the hands of anti-gay forces in Uganda, all influenced by the actions of Scott Lively and the introduction of the Anti-Homosexuality Bill, otherwise known as The Kill the Gays Bill. Lively’s defense shows how hard he has been trying to run from and cover up his involvement in the introduction of the Bill and the resulting climate of persecution against LGBTI people in Uganda.

Many believe that David Kato would not have been murdered but for Scott Lively’s actions in Uganda, where he drummed up the huge anti-gay fervor, leading to the Rolling Stone Tabloid ‘outing’ of 100 Gays with their photos and hangman’s noose calling for their death – and David Kato was amongst them on the front cover. So for him to spin this story in the face of that harm to which he is linked is reprehensible.  And now his untruthful framing of Kato’s death serves to convey a Lively message – suggesting that Kato deserved to be murdered.

In response to SMUG’s Complaint, Lively admits that he visited Uganda twice in 2002 on behalf of Abiding Truth Ministries. He also admits to being in Uganda in 2009 and speaking to members of Parliament.

And then the laughable defense, where Lively suggests that he firmly and publicly opposed the harsh penalties proposed by the Anti-Homosexuality Bill, which was never enacted. Firstly, the Bill may yet be enacted because it is still in the Parliamentary process – to say it was never enacted in simply false and misleading. It could be enacted at anytime and continues to operate as the “sword of Damacles” over LGBT Uganda’s head.  Secondly there are taped TV interviews where Lively is recorded quoting scripture in conjunction with calling for the death of gays.  It is a well know fact that until he was put under pressure of this lawsuit and only after he was bombarded with criticism, even from within the Evangelical community, and only when other Evangelicals distanced themselves from him, did he suddenly come out with comments that he opposed the death penalty.

However soon thereafter, he was quick to quote his version of scripture, again calling for death to homosexuals. See Cathy Kristofferson’s article where she exposes the Video of Lively calling for death for gays at http://oblogdeeoblogda.me/2013/01/13/anti-gay-pastor-scott-lively-radio-face-off-provides-insight-into-lies/

Another harsh truth is that in fact the death penalty clause has yet to be officially removed and is still in play, regardless of press to the contrary. While the Legal Affairs Committee has recommended its removal, it remains impossible to remove until the next parliamentary reading and that may or may not happen.
And then of course the obvious legal jargon invoked by a cowardly crouch behind the veil of his corporation – Abiding Truth Ministries – Yes, none of this was done by Lively – it’s all on behalf of Abiding Truth Ministries, the corporation, and hence he is absolved:

” 4 22) In response to paragraph 22 of SMUG’s Complaint, Lively admits that he is a citizen of the United States and resident of Springfield, Massachusetts, admits that he is a writer and evangelical minister, admits that he was licensed to practice law in California which license is currently on inactive status, admits that he is a founder and President of Abiding Truth Ministries, admits that Abiding Truth Ministries operates the DefendtheFamily.com website and a Pro-Family Resource Center, and denies all other allegations in said paragraph. Further answering paragraph 22 of SMUG’s Complaint, Lively avers that, to the extent any of the acts, omissions or conduct alleged throughout this Complaint were actually undertaken by him, they were undertaken solely in his capacity as an officer of Abiding Truth Ministries, a bona-fide corporation, and, as such, Lively cannot be held individually liable for said acts, omissions or conduct.”

This statement:

“In response to paragraph 34 of SMUG’s Complaint, Lively admits that SMUG and its constituents have had ample access to the Ugandan courts and justice system for the redress of their grievances, admits that SMUG has successfully employed the Ugandan courts and justice system to further its agenda, and denies all other allegations in said paragraph for lack of knowledge or information sufficient to form a belief about their truth

Does one really think that the Ugandan Human Rights Defenders are able to rely on Ugandan courts to successfully sue Lively?  And is Lively really going to submit himself to the jurisdiction of such courts? One also only has to look at the witch-hunt currently underway in Uganda, where four Ugandans have been detained by police conducting unlawful searches, and refused charges and bail for days on end, while paraded in the Courts in front of media. The cases have been postponed and the accused unfairly held without bail. Two of the men have reported being tortured and beaten by police. And Lively, who incited all this, has the audacity to cite the Ugandan Courts as remedial and that because of such, he should be absolved from an action being brought against him by foreigners on USA soil under the Alien Tort Act. (See http://oblogdeeoblogda.me/2013/11/15/outrage-in-ugandan-lgbt-community-as-activist-faces-possible-life-in-prison/)  .   And ironically none of this may be happening had Lively not come to Uganda to act out his hate where he drummed up the anti-gay fervor.

Lively admits: “In March 2009 on behalf of Abiding Truth Ministries,  he attended and spoke at a pro-family conference and spoke publicly to other groups and gatherings during his trip, admits that he exchanged conversational greetings with some members of the Ugandan Parliament, admits that the Ugandan media reported on his visit and speeches.”

And then my favorite admission:

“Lively admits that on January 10, 2010, Abiding Truth Ministries published a press release titled Defend the Family Intl Endorses Revised Uganda Bill, which statement speaks for itself,”

Defend The Family Intl Endorses Revised Uganda Bill

A leading U.S. based pro-family NGO has today endorsed the Ugandan anti-homosexuality bill after it was revised to remove its unacceptable provisions and to add a provision offering treatment to sufferers of same-sex attraction. Dr. Scott Lively of Defend the Family International, who advised the Ugandan Parliament on the issue of homosexuality in March rejected the prior version of the bill because it contained extremely harsh punishments including the death penalty and life imprisonment for certain forms of “aggravated homosexuality” such as adult/child incest and sexual abuse of the disabled. It also focused entirely on punishment and not rehabilitation as Dr. Lively had urged. However, as was reported today by Bloomberg.com, the Ugandan bill has been revised to remove these extreme sanctions and add a provision for therapy of homosexuality. The revised bill will soon go to a vote of the Parliament.

“When I addressed the Ugandan Parliament last Spring, my advice was to take a positive, pro-active approach to the problem, and actively promote marriage-based culture,” said Lively. “ I suggested for example that they require age-appropriate instruction to school children at every level designed to promote faithful marriage as the goal of each student, and to prepare young people to be good husbands and wives in their adult lives. By taking this approach,” Lively argued “ the entire population could be inoculated to the excesses of the sexual revolution that have done so much damage in the West.

Regarding homosexuality, specifically, I urged the government to lead the world in emphasizing rehabilitation for homosexuals through their public policy.

“Frankly, when I learned that bill included the death penalty I was mortified,” said Lively. “I publicly rejected it as written, and privately expressed my strong disapproval through my pro-family allies in Kampala, asking them to pass my concerns along to the MPs. Thank God the sponsors did in fact agree to change the bill. I can’t say that I necessarily agree with every element of the revised bill, but I believe this revision is an acceptable compromise under the circumstances and well within the prerogative of a civilized sovereign nation.”

Prior to the revision of the bill, Dr. Lively had been the subject of intense criticism in the international media, which implied without evidence that he had advocated for the death penalty. Even The New York Times joined in the attack under the headline “ After Americans Visit, Uganda Weighs Death for Gays.”

“I’m used to being hated by the Left,” said Lively, “because I speak plainly and truthfully about the global homosexual movement and it’s terribly destructive agenda. I make no apologies for my views, and accept the hate from the “gays” and their allies as a cost of standing up to a vicious adversary. Too few people are willing to do that. However, when the Left uses its media power to engender hatred against me in the general public based on lies and misrepresentations, that really riles me. I deserve an apology from The New York Times, The Guardian, Rachel Madow and all the rest of the liars who have defamed me. …But I’m not holding my breath.”

Defend The Family International is a subsidiary of Abiding Truth Ministries, which is based in California. Dr. Scott Lively is a Christian attorney, pastor, and human rights advocate who has defended the pro-family position in nearly forty countries. His teachings in Uganda were drawn from his latest book, Redeeming the Rainbow: A Christian Response to the “Gay” Agenda, which may be downloaded from his website without charge.

Whether or not Lively agrees to the death penalty, it in fact has not yet been removed from the Bill, albeit a possible recommendation by the Parliamentary Legal Affairs Committee.  Whether Lively issues a press release or not speaking against harsh punishment, such is irrelevant in his defense, as the harsh punishment was the de facto consequence, as it was put into the bill, a direct consequence of Lively’s lobbying the Ugandan Parliament and I read this as an admission of the latter.

In fact this is where Lively’s bragging about his own impact in anti-gay laws, comes back to haunt him. He cannot escape the simple fact, that even by virtue of this very press release, he is endorsing the legislation that has in fact created anti-gay fervor in Uganda and he is admitting his part in the introduction of the legislation – even through this attempt to escape culpability. While he says he was mortified at the death penalty, (though I believe that to be a lie and a cover up given all his rhetoric about homosexuals deserving death) he was the cause of the death penalty being included. If anyone should know it, Lively the lawyer should, and that is when one does not anticipate the full consequences of their actions, they may still be held responsible, nonetheless.

Lest we forget this Video where Lively says that a Bill WITH the death penalty is better than NO BILL at all: And Lively actually admits to the interview  on Current TV :

“As for the bill itself, Lively called it “a step in the right direction,” although he said he opposed the death penalty. But even there, he struggled. He told one interviewer that given the alternative of seeing Uganda become more accommodating to gays and lesbians, he would rather the bill passed “as the lesser of two evils.”

MURDERING UGANDA

By Pastor Scott Lively, J.D., Th.D.
President, Defend the Family International

Uganda is being murdered. The nation once called “The Pearl of Africa” by Winston Churchill, a lush and beautiful country as fertile as the Nile Delta. It is the nation that retained its self-rule through centuries of African colonialism, the society that survived even the atrocities of the cannibal cultist Idi Amin, the culture that has been thriving in Christian revival for over a dozen years.

This great and honorable nation, alone in Africa to have all but conquered the scourge of AIDS through abstinence – and whose First Lady led a holy gathering of thousands of believers on the eve of the millennium, dedicating her homeland “to Jesus Christ for a thousand years” – this Uganda, a shining light in the Dark Continent, is being murdered.

The murderers are the lavender Marxists, the now-global network of sexual revolutionaries bent on remaking the entire world in their own perverted image, whose juggernaut has toppled even once mighty Britain, crushing under their lavender boots after eight centuries the symbol of its Christian power: the Magna Charta, whose first principle had proclaimed “The English church must be free!” These revolutionists of Sodom, who march triumphantly through all the major cities of the western world to flaunt their defeat of moral law, and who hold both Hollywood and the heart of America’s president in their iron grip: These very same zealots have fixed their malevolent gaze on Christian Uganda.

Uganda is the only country in the world with a national holiday commemorating its rejection of sexual perversion. Every June 3 it honors the 22 young men and boys who were tortured and roasted alive in 1886 by homosexual King Mwanga, because they refused to submit to sodomy. Is it any wonder, then, that Uganda has reacted violently against the army of agitators, led by George Soros, who now seek to re-homosexualize Ugandan culture?

It is as if the militant ranks of “Code Pink” were transported back to 1890s America to agitate for “sexual freedom.” Our great grandparents would not have countenanced this. There would have been violence, as there has now been in Uganda. And that is, of course, the strategy: the agents provocateur are goading unsophisticated natives into over-reacting, while the “gay” media lie in wait to catch the images and spin the propaganda that is even now poisoning the gullible against the Ugandans.

Ugandan homosexual activist David Kato was recently beaten to death with a hammer, a horrific crime. These very media have rushed eagerly to judge this a hate crime and to blame those, like me, who have spoken against homosexuality in Uganda. It is the central (but patently false) narrative of the left that all criticism of homosexuality leads inevitably to violence and murder.

Yet the killer has now been caught and confessed that he was a live-in male prostitute who murdered Kato for failing to pay him as promised. The “gay” hate-narrative has failed, the Ugandan rejection of “gay” culture has been vindicated, and the finger-pointing media have pulled quietly back into the shadows – for now.

There is indeed evil in Uganda today, but it is not the reaction of Christian and Moslem citizens to the rape of their culture. It is the pink-gloved hand of western powers that are cutting the throat of Africa’s most God-fearing country, and one of the world‘s most promising Christian democracies.

So while Lively is denying any wrongdoing, denying jurisdiction, denying he is deserving of this lawsuit, he has lost all his motions to avoid trial, and the case is moving forward. While this fascinating and gutsy lawsuit brought for the Plaintiffs by The Center for Constitutional reform, is keeping Scott Lively on his toes and has him in defensive and justification mode, the man is unashamedly continuing his drive to persecute gays and continuing to boast his maneuvers, except now he is quiet on the Africa front and imparting his hateful rhetoric and conduct in Russia and surrounding countries.  Hopefully as he gets deeper into trial, he will be kept busy enough and perhaps scared enough to keep his hateful nose out of foreign countries.
